GENERAL TERMS AND CONDITIONS

1 Introduction

1.1 Thank you for engaging with Venture UK Group Limited T/A Autostone to carry out motor vehicle repair and servicing as detailed in our service plans. Our company registration number is 11397641 and our registered office is Brookside House C/O 24 Brookside Road, Oxhey, Watford, Hertfordshire, WD19 4BP.

1.2 We will provide you with motor vehicle repair and servicing as detailed in our various plans. The following are our Standard Terms and Conditions of Business, under which we will carry out all work for you. We may also provide a letter setting out any further terms agreed between us and you, in which case that letter will take priority over these terms.

1.3 These Terms shall apply to all matters in respect of which Venture UK Group Limited T/A Autostone accepts instructions from you to perform professional services (“Services”). In these terms, “Venture UK Group Limited T/A Autostone”, “we” or “us” means Venture UK Group Limited T/A Autostone. “You” are Venture UK Group Limited T/A Autostone’s customer, being the person, body or company who instructs Venture UK Group Limited T/A Autostone and purchases the service and repair plan from us.

2 Our Obligations

2.1 Our staff are qualified motor vehicle mechanics and vehicle repair professionals and must comply with the codes of professional conduct issued by the Motor Ombudsman, contactable at www.themotorombudsman.org/ and the Institute Of The Motor Industry, contactable at www.theimi.org.uk/.

2.2 It is our responsibility to undertake the services provided competently, conscientiously and objectively, putting the interests of our customers first.

3 Our charges

3.1 Our charges are fixed charges that relate to the agreed subscription plan. The rates are reviewed periodically and any changes will be communicated to you in advance of the renewal of your subscription.

3.2 Value added tax Where applicable, VAT (Value Added Tax, currently 20 per cent) will be added to our charges where appropriate.

4 Subscription

4.1 Subscription to the chosen repair and service plan will be for a term of 12 (twelve) months which is renewed annually.

4.2 Payment of the monthly subscription fee shall be taken by Venture UK Group Limited T/A Autostone on the exact day every month which was agreed between you and us when the chosen repair and service plan was initiated.

4.3 We will remind you of the need to renew your chosen subscription up to 30 days prior to the renewal date and the subscription will be automatically renewed unless we receive your instructions to the contrary by the renewal date.

5 Cancellation

5.1 You have the right to cancel your subscription within the cooling off period (which begins from the moment you purchase your subscription and continues until 14 days from the start date or the date you receive your documents, whichever is later).

5.2 If you cancel your subscription within the cooling off period but have used the service, we have the right to charge you for the service provided which will be deducted from the initial payment made by you. We also have the right to charge you for the value of any work undertaken that exceeds the initial payment made by you.

6 What is not covered

6.1 Our repair and service subscription does not provide for the following:

a). Any vehicle servicing or re-assembly, routine servicing, maintenance or repairs or putting right work that you, a garage or third party have undertaken.

b). Garage labour costs: the cost of garage charges by a garage not approved by us for a permanent repair after we have undertaken a temporary repair to make the vehicle driveable.

c). Service to vehicles at a garage: we will not attend If any work has been undertaken by a garage that is not an approved garage as per the terms of our subscription.

d). Service to vehicles on private property: we cannot carry out repairs to your Vehicle on private property unless you have the permission of the owner.

e). Fuel draining: putting it right if you put in the wrong fuel or oil.

f). Storage of your Vehicle: if we have to store it for any reason, you will have to pay the storage costs and the vehicle will be stored at your risk.

g). Trade transportation: the provision of service to vehicles bearing trade plates or vehicles that we have reason to believe have just been bought at auction.

h). Transporting from trade premises: we cannot provide assistance if you are moving the vehicle as part of a commercial activity.

i). Breakdown recovery: we will not provide breakdown recovery or transportation where your vehicle cannot be repaired at the roadside. Any such services will be at your own cost.

j). Participation in sporting events: we will not attend to your vehicle if it’s been involved in motor racing, off-road driving, rallies, track days, duration or speed tests.

k). Malicious damage or Vandalism: we cannot provide help if your vehicle is damaged due to malicious damage or vandalism. We can help to arrange recovery but you will need to pay for this (and claim it back from your motor insurer).

l). Commercial use: our service does not cover repair and servicing of any vehicles used at any time for any commercial purpose, such as carrying items/people for money, delivery or collection of goods.

7 Data Protection

7.1 We are required to comply with the relevant Data Protection Acts wherever we obtain or use any personal data from clients (including names, addresses and any personal details). We will use your personal data to provide services to you.

7.2 We will not use your personal data for any purpose, other than set out in this condition, without your consent unless we are entitled or required to do so by law or under a court or regulatory authority order.

7.3 Any use of your personal data for any purpose will be in accordance with our Privacy Policy.

8 Customer Care and Complaints

8.1 We value our good relationships with our customers. However, we accept that from time to time difficulties and misunderstandings may arise. If you have any problems, you should feel free to discuss your concerns with the members of our staff dealing with your work.

8.2 However, if after such discussions you feel that the matter has not been adequately dealt with, you may invoke our complaints procedure. Our Complaints Handling Policy is freely available upon request.

9 Force Majeure and Exclusion of Our Liability

9.1 Your relationship is with Venture UK Group Limited T/A Autostone who will have exclusive liability for the carrying out the services and for any negligent act or omission by it in the course of providing those services. You agree that no individual employee or agent of Venture UK Group Limited T/A Autostone will have any personal liability for those services. You also agree that an employee or agent of Venture UK Group Limited T/A Autostone signing in his or her own name on any letter, email or other document in the course of providing services does not imply he or she is assuming any personal liability separate to that of Venture UK Group Limited T/A Autostone. Except for acts of fraud you agree that any claim brought in respect of any matter on which we were instructed will be made against Venture UK Group Limited T/A Autostone and not against any individual employee or agent of Venture UK Group Limited T/A Autostone.

9.2 You agree that we shall have no liability nor shall we be deemed to be in breach of any duties or obligations owed to you if at any time we are prevented, delayed or hindered in complying with such duties and/or obligations by reason of any circumstances beyond our reasonable control.

9.3 Nothing in these Terms excludes or limits the liability of us for death or personal injury caused by our negligence, or for fraudulent misrepresentation.

9.4 We shall not be liable to you for any indirect or consequential loss or damage, costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) or loss or damage (contractual, tortious, breach of statutory duty or otherwise) which arises out of or in connection with the contract (including loss of profit or other economic loss), or for any liability incurred by us to any other person for any economic loss, claim for damages or awards howsoever arising from the services or otherwise.

9.5 We maintain professional insurance cover appropriate to a company of our size and standing.

10 Governing Law and Jurisdiction

Our relationship, as set out herein, is governed by English law. By retaining this firm both we and you submit to the non-exclusive jurisdiction of the English courts in respect of any claims brought by us and to the exclusive jurisdiction of the English courts in respect of claims brought against us.
